Terms of Service

These Terms govern your access to and use of Signal Fax websites, applications, fax services, and related features.

Agreement

By creating an account, purchasing a subscription, or accessing or using Signal Fax, you agree to these Terms of Service (“Terms”). If you use Signal Fax for an organization, you represent that you have authority to bind that organization, and “you” includes that organization.

If you do not agree to these Terms, do not use the service.

The service

Signal Fax provides internet-based fax and related communications tools, which may include fax numbers, inbound and outbound faxing, document storage, integrations, APIs, administrative controls, and other features described on our website or in your plan.

Features, limits, and availability may vary by plan. We may improve, modify, or discontinue features from time to time. We will use commercially reasonable efforts to provide notice of material changes that substantially reduce paid functionality.

Accounts & security

You must provide accurate account information and keep credentials secure. You are responsible for activity occurring under your account and for promptly notifying us of suspected unauthorized access. Account administrators are responsible for managing their users, permissions, and organizational settings.

You may not share credentials in a manner that defeats account or plan restrictions, access another user’s account without authorization, or attempt to bypass security controls.

Acceptable use

You may use Signal Fax only for lawful purposes. You may not use the service to send unlawful, fraudulent, deceptive, threatening, harassing, infringing, or malicious content; distribute malware; impersonate others; facilitate fraud; interfere with the service; probe or circumvent security controls; or violate applicable telecommunications, privacy, marketing, export, sanctions, or other laws.

You are responsible for having all rights, permissions, and legal bases necessary to transmit and process content through Signal Fax, including any consent required for communications you initiate.

We may investigate suspected abuse and may restrict or suspend activity when reasonably necessary to protect users, networks, third parties, or the service.

Healthcare & HIPAA

Signal Fax may be used in workflows involving protected health information when the customer and Signal Fax have entered into an applicable Business Associate Agreement (“BAA”). Where a BAA applies and conflicts with these Terms regarding protected health information, the BAA controls for that information.

Using Signal Fax does not by itself make your organization compliant with HIPAA or any other law. You remain responsible for your own policies, configurations, access controls, workforce practices, and legal obligations.

Third-party services

Signal Fax may interoperate with third-party services, including identity providers, cloud platforms, telecommunications providers, payment processors, and user-enabled integrations such as Google services. Your use of a third-party service may also be governed by that provider’s terms and privacy policies.

We are not responsible for third-party products or services that are outside our control, but we remain responsible for our obligations concerning data we process under our Privacy Policy and any applicable BAA.

Fees, subscriptions & cancellation

Paid services are billed according to the plan and pricing presented when you subscribe or otherwise agree to purchase services. Usage-based charges, taxes, and other disclosed charges may apply. Unless otherwise stated, recurring subscriptions renew automatically until canceled.

You may cancel in accordance with the cancellation options available in your account or plan. Cancellation stops future renewal but does not ordinarily refund charges already incurred, except where required by law or expressly stated otherwise.

Your content

You retain your rights in documents and other content you submit to Signal Fax. You grant us only the rights reasonably necessary to host, process, transmit, secure, back up, and otherwise handle that content to provide the service and comply with law.

Our handling of personal information is described in our Privacy Policy. Account-level retention settings and contractual requirements may affect how long content remains available.

Availability & warranties

We work to provide a reliable service, but telecommunications networks, recipient fax systems, internet services, and third-party providers are not entirely within our control. Unless a separate written agreement says otherwise, the service is provided on an “as is” and “as available” basis to the maximum extent permitted by law.

To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the service will be uninterrupted or error-free.

Limitation of liability

To the maximum extent permitted by applicable law, Signal Fax will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, or data, arising from or related to the service.

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the service will not exceed the amount you paid to Signal Fax for the service during the twelve months immediately preceding the event giving rise to the claim. Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.

Suspension & termination

You may stop using Signal Fax at any time, subject to applicable billing commitments. We may suspend or terminate access for material breach of these Terms, nonpayment, unlawful or abusive use, security risk, or where required by law. Where reasonably practicable, we will provide notice and an opportunity to cure before terminating for breach.

Changes & contact

We may update these Terms from time to time. We will post the revised Terms here and update the date above. If a change materially affects your rights or obligations, we will provide reasonable notice where required.
